The General Contracting Conditions regulate the distance selling relationship between ENRIQUE TOMAS SL and the user or client, in accordance with the legal stipulations, especially Law 7/1998, of 13 April, on General Contracting Conditions, Law 3/2014, of 27 March, which modifies the revised text of the General Law for the Defence of Consumers and Users, the applicable and current regulations on data protection, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce.

ENRIQUE TOMAS SL reserves the right to make the modifications it deems appropriate, without prior notice, in the General Conditions. These modifications may be made, through its websites, by any means admissible by law and shall be binding during the time they are published on the website and until they are not validly modified by subsequent ones. However, ENRIQUE TOMAS SL reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to the present General Conditions when it considers it appropriate, announcing them in due time and form.

The purpose of the website is the sale of Iberian products, accessories and courses.

The duration of the contract shall be linked to the delivery of the product without prejudice to the right of withdrawal.

You can also subscribe to the newsletter to receive offers on the above products or general information that may be of interest to you.

As a user or client, you expressly declare that you know, understand and accept the conditions of use and privacy and these general contracting conditions. Likewise, you declare that you are of legal age and have the necessary legal capacity to access the ENRIQUE TOMAS SL websites and to contract through them.

It is essential that you register as a user of the website to make the online purchase. You can access the corresponding section for registration on the website itself. In accordance with the provisions of the current and applicable regulations on Personal Data Protection, ENRIQUE TOMAS SL informs users that the personal data collected during the registration process and subsequent purchase, will be incorporated into the processing system owned by ENRIQUE TOMÁS SL, in order to process such actions by the user and manage subsequent actions arising from them. During the purchase process you must identify yourself with the user name and password provided. These data will not be made public. In this same section you will have access to a history of your orders, this is only a consultation section but its management is allowed, and the user can delete those records that he/she considers it is not necessary to view.

Upon receipt of the product at the delivery address provided, the customer will receive an invoice or a copy of the order.

Offer and validity

In the case of a product on offer, the offer price and the validity of the offer shall always be indicated next to the essential characteristics of the product.

In compliance with the regulations in force, ENRIQUE TOMAS SL offers information about all the articles on sale, their characteristics and prices. The products offered in our online shop, incorporate a photograph and the essential characteristics of the same, this is the information obtained from the manufacturer itself. The colour of the product, observable in the photograph is not binding. It is identified in the characteristics.

ENRIQUE TOMAS SL is responsible for the lack of conformity of all the products offered on the website for a period of two years from delivery. ENRIQUE TOMAS SL has an after-sales service during the indicated period. Warranties 

ENRIQUE TOMAS SL is responsible for the lack of conformity of all the products offered on the website during a period of two years from delivery. ENRIQUE TOMAS SL has an after-sales service during the indicated period. The client will be able to go to the establishment of ENRIQUE TOMAS SL, to the after-sales service, by e-mail to web@enriquetomas.com or to the points established by the own supplier. In case of doubt, he/she can contact the e-mail web@enriquetomas.com.

Prices

The prices and offers presented on the Website include VAT (Value Added Tax) and are only valid for orders placed online through the Website. These prices and offers may not match those available in Enrique Tomás stores nationwide. Prices are in Euros.
In general, and in application of the provisions of Article 68 of Law 37/92, all deliveries made to final consumers are subject to VAT at the rates applicable in Spanish territory. If any other tax is applicable, this will be indicated (IGIC or IPSI).

Shipping costs

In this screen you will see the shipping costs information for your order depending on the shipping address you have indicated in the previous steps. Remember to accept the general conditions in order to process the order.
Shipping costs apply to each order. The exact costs for each order depend on the country of receipt. Under no circumstances will orders be shipped to areas that are not included in the list of countries to which Enrique Tomás can ship its products.

Payment

The client will be able to pay the amount of his order opting for any of the following ways.
During the purchase process you must indicate your choice:

• - VISA or MASTERCARD credit card.

All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on the standard security technology SSL (Secure Sockets Layer). All the information you transmit to us travels encrypted through the network. Likewise, your credit card information is entered directly on the bank's website, at the POS (Point of Sale Terminal of the Bank) and is not entered or recorded on any server of ENRIQUE TOMAS SL.

When paying with VISA or MASTERCARD you will always be asked for the following data: the card number, the expiration date, and a Validation Code that coincides with the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.

This form of payment is valid only on the web.

When the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and recredit entries in the accounts of the supplier and the cardholder will be made as soon as possible.

However, if the purchase had been effectively carried out by the holder of the card and the demand of return was not a consequence of having exercised the right of withdrawal or resolution and, therefore, had unduly demanded the cancellation of the corresponding charge, he will be obliged to ENRIQUE TOMAS SL to compensate the damages caused as a result of such cancellation.

• - Bank Transfer

When selecting the bank transfer you will receive, together with the confirmation of your order, an e-mail with the bank details of ENRIQUE TOMAS SL.
It is very important that when making the transfer you indicate in the subject the order number, as well as your name and surname, and make the transfer within 3 days after the order confirmation date in order to validate it.

If you wish, you can send us the proof of the transfer by fax, or by e-mail web@enriquetomas.com. But in any case, the order will not be considered effective until our administration department does not have bank confirmation of the transfer.
We remind you that the payment must be made in EUROS and that all possible exchange and bank commissions are at your expense.

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer you always inform your bank to take charge of the commissions in origin, those bank commissions and expenses corresponding to your bank. Otherwise, ENRIQUE TOMAS SL could paralyze the shipment of your order if we do not receive the full amount of the order.
The possible commissions of change and banking are in charge of the client.

• - PayPal

It allows to send payments on the Internet in a safe and comfortable way. The PayPal network is based on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution. PayPal offers a service specially designed for those who are not satisfied with traditional payment mechanisms.

Delivery

• - Where and when

Deliveries are made Monday through Friday. No deliveries are made on weekends or during local holidays. Orders can only be delivered to private residences or offices. Deliveries are made during office hours. Therefore, to facilitate deliveries, Customers are asked to use their work addresses or other addresses where there is someone who can receive the shipment.

• - Delivery time

Orders for the Spanish territory (Peninsula) are normally delivered within 1-2 working days from receipt. Once the order is shipped, the Customer receives an email notification with the estimated delivery date. In the case of orders outside Spain, this delivery time can be between 3 and 5 working days from order confirmation.
These delivery times can be extended by 12-24 hours if the order contains, for example, a knife-cut ham, since we cut it at the moment of receiving the order so that you receive it practically freshly cut and enjoy it to the maximum.
During the second half of December these usual delivery times can double due to the high volume of daily orders we receive in the days leading up to Christmas.

• - Verification upon receipt

The Customer must check the condition and contents of the package within a reasonable period of time after receipt to verify that everything is correct and in accordance with the order. If no communication of rejection of the products has been received within 7 days of delivery, Enrique Tomás will consider that the Customer has accepted the same.

The availability of the products offered by ENRIQUE TOMAS SL can vary according to the demand of the customers. Although ENRIQUE TOMAS SL updates the stock periodically, the product requested by the customer could be out of stock at that time. In case of non-execution due to unavailability, ENRIQUE TOMAS SL will notify the customer by e-mail as soon as it becomes aware of this situation. The period of this communication will not exceed in any case the maximum period of 30 days. ENRIQUE TOMAS SL will be able to give the double option of: to supply to the client without price increase, a product of similar characteristics or of superior quality, or except for justified and demonstrable reasons by ENRIQUE TOMAS SL within this same period to pay the sums paid for the cancelled order.

• Right of withdrawal, returns and claims

The buyer will have a period of fourteen calendar days to withdraw, from the day the customer receives the product, without penalty and without any indication of the reasons.

The exercise of the right of withdrawal must be made by notification through telephone communication to 933838485, by email to web@enriquetomas.com, by sending your letter to our postal address C/ HOLANDA 27, 08917, BADALONA (BARCELONA), or through the withdrawal form. The customer's data will be kept for the period strictly necessary to comply with the aforementioned purpose (8 years), unless legally obliged to do so. Likewise, the legitimate basis of the treatment is for legal compliance.

According to the provisions of Article 103 of Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users, supplies of services or goods made according to consumer specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from withdrawal.

In any case, the products to be returned must be in perfect condition, unused and in their original packaging. Therefore, in order to avoid transport problems, please make sure that the package is properly protected and sealed. Once received, we will check its condition. As soon as we check that the item/s, as well as the possible components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to refund the money paid.

In hams, shoulder and charcuterie, it is necessary to return at least 80% of the weight of the product. That is to say, we will not accept started pieces in which more than 20% of the product is missing. The hams and shoulders must come with the original seals, tags or labels, without having been tampered with.

Return of the defective product

In case the product is not in good condition and the causes attributable to this, are not a consequence of the client, this one will have right to the return of the product, informing ENRIQUE TOMAS SL of the reason of return across anyone of the means facilitated in the present conditions of contracting, and without any cost for the client. This return for reason of defect or bad condition of the product will not be considered a right of withdrawal.

The ENRIQUE TOMAS SL undertakes to assume the cost of the return and to return the product for a new one in accordance with conditions accepted at the time of sale.

Jurisdiction

Also, ENRIQUE TOMAS SL reserves the right to file civil or criminal actions it deems appropriate for the misuse of its website and content or for breach of these conditions.
The relationship between the user and the provider shall be governed by the regulations in force and applicable in the Spanish territory. If any controversy arises, the parties may submit their disputes to arbitration or go to the ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard.
