The General Conditions of Contract regulate the distance selling relationship between ENRIQUE TOMAS SL and the user or client, in accordance with the legal stipulations, in particular, Law 7/1998, of April 13, on General Conditions of Contract, the Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users, the applicable and current regulations on data protection, Law 7/1996, of 15 of January of Ordination of the Retail Trade, and to the Law 34/2002 of July 11, of Services of the Society of the Information and Electronic Commerce.

ENRIQUE TOMAS SL reserves the right to make the modifications it deems appropriate, without prior notice, in the General Conditions. Said modifications may be made, through their websites, by any admissible form in law and shall be binding during the time they are published on the web and until they are validly modified by subsequent ones. However, ENRIQUE TOMAS SL reserves the right to apply, in certain cases, a Particular Contract Conditions in preference to these General Conditions when it deems appropriate, announcing them in a timely manner.

The purpose of the website is to sell Iberian products, accessories and courses.

The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal.

Also, you can subscribe to the newsletter to receive offers of the referred products or general information that may be of interest.

Prices

The prices and offers presented on the Website include VAT (Value Added Tax) and are only valid for orders placed online through the Website. These prices and offers may not match those available at Enrique Tomás stores across the country. The prices are shown in euros.

In general, and in application of the provisions of Article 68 of Law 37/92, all deliveries made to final consumers are subject to VAT at the rates applicable in Spanish territory. If any other tax were applicable, this would be indicated (IGIC or IPSI).

Shipping costs

On this screen you will see the information of the shipping costs for your order depending on the shipping address you have indicated in the previous steps. Remember to accept the general conditions to process the order.

Shipping costs apply to each order. The exact expenses of each order depend on the country of reception. Under no circumstances will orders be sent to areas that are not included in the list of countries to which Enrique Tomás can ship their products.

Payment

The customer can pay the amount of your order by choosing any of the following forms.

• VISA or MASTERCARD credit card

All transactions involving the transmission of personal or banking data are made using a secure environment, a server based on the standard security technology SSL (Secure Sockets Layer). All information transmitted to us travels encrypted through the network. Likewise, the information about your credit card is entered directly on the bank's page, in the POS (Point of Sale Terminal of the Bank) and they are not entered or registered in any server of ENRIQUE TOMAS SL.

When paying with VISA or MASTERCARD card you will always be asked for the following information: the card number, the expiration date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA card or MASTERCARD, offering, in this way, more guarantees about the security of the transaction.

This form of payment is valid only on the web.

When the amount of a purchase has been charged fraudulently or improperly using the number of a payment card, its holder may demand the immediate cancellation of the charge. In this case, the corresponding debit and debit entries in the accounts of the provider and the holder will be made as soon as possible.

However, if the purchase had actually been made by the cardholder and the refund requirement was not a consequence of having exercised the right of withdrawal or resolution and, therefore, had unduly demanded the cancellation of the corresponding charge, that will remain forced against ENRIQUE TOMAS SL to compensate for the damages and losses caused as a result of said cancellation.

• Wire transfer

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer always inform your bank to take charge of the commissions at source, those bank commissions and expenses corresponding to your entity. If not, ENRIQUE TOMAS SL could paralyze the shipment of your order by not receiving the full amount thereof.

Delivery

• Where and when

Deliveries are made Monday through Friday. No deliveries are made on weekends or during local holidays. Orders can only be delivered in private residences or offices. Deliveries are made during office hours. Therefore, to facilitate deliveries, Clients are asked to use their work addresses or other addresses where there is someone who can receive the shipment.

• Delivery term

Orders for Spanish territory (Peninsula) are normally delivered within 1-2 working days of receipt. Once the order is sent, the Customer receives a notification email with the estimated delivery date. In the case of orders outside Spain, this delivery period may be between 3 and 5 working days from the order confirmation.

These delivery times can be extended 12-24 hours if the order contains for example a ham cut with a knife, since we cut it at the moment of receiving the order so that it receives it practically freshly cut and enjoy it to the fullest.

During the second half of December these usual delivery times can double due to the high volume of daily orders we receive in the days before Christmas.

• Verification at reception

The Client must verify the status and content of the package within a reasonable period of time after receipt to verify that everything is correct and in accordance with the order. In case no communication of rejection of the products has been received within 7 days of the delivery, Enrique Tomás will consider that the Client has accepted the same.

The availability of the products offered by ENRIQUE TOMAS SL may vary depending on the demand of customers. Although ENRIQUE TOMAS SL updates the stock periodically, the product requested by the customer could be sold out at that time. In the event of non-execution due to unavailability, ENRIQUE TOMAS SL will notify the client at the time they have knowledge of this situation, by means of an electronic mail. The period of this communication will not exceed in any case the maximum period of 30 days. ENRIQUE TOMAS SL may offer the double option of: supplying the customer without a price increase, a product with similar characteristics or superior quality, or unless justified and demonstrable by ENRIQUE TOMAS SL within this same period to pay the amounts paid for the order canceled.

Right of withdrawal, returns and claims

The buyer will have a period of fourteen calendar days to desist, from the day the customer receives the product, without any penalty and without indication of the reasons.

The exercise of the right of withdrawal must be made by notification by telephone to 933838485, by sending an email to web@enriquetomas.com, sending your letter to our postal address C / OCCITANIA 45, 08911, BADALONA (BARCELONA), or through of the withdrawal form. The client's data will be kept for the period strictly necessary to fulfill the previously foreseen purpose (8 years), except legal obligation. Likewise, the legitimate basis of the treatment is for legal compliance.

As established in article 103 of Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users, the supplies of services or goods made according to the specifications of the consumer or clearly personalized, or that, by their nature, can not be returned or may deteriorate or expire quickly, are exempt from withdrawal.

In this case the customer will be responsible for the costs of the return.

In any case, the products to be returned must be in perfect condition, unused and in their original packaging. Therefore, it is requested that in order to avoid transport problems, it should be ensured that the package is properly protected and sealed. Once received, we will check your status. The moment we check that both the article/s, as the possible components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to return the money paid..

Return of the defective product.

In the event that the product is not in good condition and the causes attributable to it, are not the result of the customer, it will be entitled to return the product, informing ENRIQUE TOMAS SL of the reason for return through any of the means provided in these contracting conditions, and at no cost to the client. This return due to defect or poor condition of the product will not be considered a right of withdrawal.

The ENRIQUE TOMAS SL undertakes to assume the cost of the return and to return the product for a new one in accordance with conditions accepted at the time of sale.

Conditions of the cutting courses

The cutting course has a duration of 3 hours that includes theoretical and practical instruction, tasting of ham qualities, ham, book and sandwich.

The course can only be done by students over 18 years of age and will be taught in Spanish.

The piece of ham to be cut will be a Gran Reserva ham provided by Enrique Tomás, this ham is not included in the price of the course and all the cut material will be available to the store. Participants can buy their own ham, of any variety, with a 10% discount. In case you want to buy your own piece and take home all the material cut, the participant must inform in advance, if it is your case, contact us at web@enriquetomas.com or phone 936 887 673.

When making the purchase of this Course of Cut of Ham you will acquire a voucher in digital format that you can print and with which you can reserve a place in any of the available dates to learn how to cut a ham from the hand of our team of professionals.

This voucher will be sent via e-mail to the name of the person you indicate and in that same e-mail, we will explain the step-by-step instructions to make a reservation and attend the course.

The voucher for the Enrique Tomás Ham Cutting Course is valid for 6 months from the date of purchase.

Once confirmed the place for the course, on a certain date, cancellations will only be accepted with 48h. in advance.

Jurisdiction

Likewise, ENRIQUE TOMAS SL reserves the right to present civil or criminal actions it deems appropriate for the improper use of its website and contents or for the breach of these conditions.

The relationship between the user and the provider will be governed by the regulations in force and applicable in Spanish territory. If any dispute arises, the parties may submit their disputes to arbitration or go to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard.
