TERMS AND CONDITIONS Legal Bases of Participation in the Promotion

PROMOTION ORGANIZING COMPANY

The company Enrique Tomás with address at Ptge. Mar d'Alboran nº2, 2º1ª, 08918 Badalona, Spain, and Tax ID B-59544957 is organizing for promotional purposes the contest "Travel to Ibiza for Free with Enrique Tomás" (hereinafter referred to as "the Promotion"), which will take place nationwide through the Internet and is exclusive to users residing in Spain who are of legal age, as specified in the participation conditions section.

START DATE AND END DATE

The Promotion will start on 11/07/2017 and end on 15/08/2017.

PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS

The participation requirements are as follows:

• Persons residing in Spain and over 18 years old may participate.
• Participants can only register once in this promotion.

The mechanics of the Promotion consist of posting a photo showing one of the plushies (ham plush) hidden in the Enrique Tomás stores along with the participant's favorite product. This photo must be posted on social media with the hashtag #HammingWithEnriqueTomas.

PROMOTION CONDITIONS AND PRIZES

One winner and one alternate will be chosen based on the internal jury's criteria, taking into account the most original photo. Employees of Enrique Tomás and their family members cannot participate.

The winner will receive as a prize: Two round-trip flights to Ibiza on a date agreed upon between the company and the participant during the month of September. Accommodation and travel extras will be the responsibility of the participant.

DISQUALIFICATIONS AND PENALTIES

If it is evident that any of the participants do not meet the requirements specified in the Terms or the data provided for participation is not valid, their participation will be considered null, and they will be automatically excluded from the Promotion, forfeiting any rights to the prizes awarded under this Promotion.

PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions deemed inappropriate, offensive, injurious, discriminatory, or that could violate the rights of third parties will not be allowed. Comments that go against an individual, violating the principles of the right to honor, personal and family privacy, and self-image, will also not be permitted. We will not be responsible for any damages caused by comments made by participants in the Promotion that could offend the sensibilities of other participants.

DISCLAIMER OF LIABILITY

By way of example, but not limited to, we are not responsible for possible losses, thefts, delays, or any other circumstances attributable to third parties that may affect the development of this Promotion, nor are we responsible for the participant's use of the prize obtained from this Promotion.

We do not assume responsibility in cases of force majeure or fortuitous events that could prevent the realization of the Promotion or the full or partial enjoyment of the prize.

The promotion is not sponsored, endorsed, administered, or associated in any way with Facebook, so Participants release Facebook and INSTAGRAM from any responsibility for eventual damages arising from it.

In accordance with the provisions of Organic Law 15/1999, of December 11, on the Protection of Personal Data, and its development regulation, each participant, by accepting these legal terms, cons ents to the inclusion of their personal data in a file for which we are responsible and used to send them newsletters and commercial and promotional communications related to our services by mail, telephone, email, SMS/MMS, or other electronic means.

CHANGES

We reserve the right to modify or expand these promotional terms to the extent that they do not harm or undermine the rights of participants in the Promotion.

APPLICABLE LAW AND JURISDICTION

These legal terms will be governed in accordance with Spanish law. The courts and tribunals of the city of Badalona will have jurisdiction to resolve any claim or dispute that may arise regarding the validity, interpretation, or compliance with these terms.
